Hospitals and surgical facilities often engage in certain marketing of physicians who are members of their medical staffs. While such activity may be appropriate, even at no cost to physicians, the scope and type of marketing must be monitored to ensure compliance with fraud, abuse and physician self-referral laws. We focus on two key areas of compliance as it relates to this area: The Stark Law and the Federal Anti-Kickback Statute.
